Who we are
BrandBrine is a remote-first creative digital agency. In this policy, “BrandBrine”, “we”, “us” and “our” mean [LLC legal name], a limited liability company registered in [US state], with its office at 2063 Caesar Pl, Bronx, New York 10473, USA.
We are the controller of the personal information described in this policy. That means we decide how and why it is used.
You can reach us about anything in this policy at [email protected].
What this policy covers
This policy covers personal information we collect through brandbrine.com and its pages, our contact and newsletter forms, our booking calendar, emails and calls with us, and the work we do for clients.
It does not cover other websites we link to, or the websites and accounts we build or run for clients. Each of those has its own privacy policy.
Information we collect
Information you give us
- Contact form: your name, email address, company or website (optional), the services you are interested in (optional) and your message.
- Booking a call: your name, email address, company, phone number (if you give it), any notes you add, your time zone and the time you choose.
- Newsletter: your email address and the topics you sign up for.
- Working with us: contact and billing details, project briefs, brand assets, content and any account access you share with us so we can do the work.
- Emails and calls: anything you choose to tell us when you write to us or speak to us.
Information collected automatically
- Technical data: your IP address, browser and device type, and the pages you visit, recorded in our hosting and security logs.
- Spam protection: when you book a call, a scrambled (hashed) version of your IP address is kept for one hour to stop repeated automated bookings.
- Cookies and similar technologies: see our Cookie Policy.
We don’t ask for sensitive information, such as health details, and we ask you not to send it to us.
How we use it, and why we're allowed to
Where UK or EU data protection law applies to us, we need a legal reason (a “lawful basis”) for each use. These are ours:
| What we do | Information used | Lawful basis |
|---|---|---|
| Reply to your message and answer your questions | Contact form details, emails | Our legitimate interest in responding to enquiries |
| Arrange, confirm, remind you about and run discovery calls | Booking details | Steps you ask us to take before a contract; legitimate interest |
| Deliver projects, invoice and keep project records | Client and project details | Performing our contract with you |
| Send our newsletter | Email address, chosen topics | Your consent, which you can withdraw at any time |
| Keep the website secure and working, and stop spam | Technical data, hashed IP address | Our legitimate interest in a safe, working website |
| Understand how the website is used, so we can improve it | Analytics data | Your consent (we only use analytics if you agree) |
| Meet our legal, tax and accounting duties | Client and billing records | Legal obligation |
We don’t sell your personal information, and we don’t use it for automated decisions that have legal or similarly significant effects on you.
Who we share it with
We share personal information only with the service providers that help us run BrandBrine, and only what they need to do their job. They act on our instructions and must keep it safe.
| Who | What they do for us |
|---|---|
| Our website hosting provider | Hosts the website, the form entries and the booking records |
| Google (Gmail and Google Meet) | Sends and receives our emails, including booking confirmations and reminders, and hosts video calls |
| Cloudflare | Routes email sent to our domain |
| Email newsletter provider (if we use one) | Stores newsletter subscribers and sends the newsletter |
| Website analytics provider (if we use one) | Measures how the website is used, only with your consent |
| Accounting, invoicing and payment providers | Invoicing and payments for client work |
Our team works from New York, Frankfurt and Dhaka, so team members in those offices may see your information when they work on your enquiry or project. We may also share information if the law requires it, to protect our rights, or as part of a sale or reorganisation of our business.
International transfers
Because our team and some of our providers are outside the UK and the European Economic Area, your information may be transferred to and stored in other countries, including the United States and Bangladesh.
When we transfer information out of the UK or EEA, we use a recognised safeguard, such as the European Commission’s Standard Contractual Clauses, the UK International Data Transfer Addendum, or a provider’s certification under the EU-US Data Privacy Framework. You can ask us for more detail.
How long we keep it
- Messages and enquiries: 24 months after our last contact, unless they lead to a project.
- Bookings: 12 months after the call.
- Newsletter: until you unsubscribe.
- Client and billing records: 7 years after the project ends, to meet tax and accounting rules.
- Hashed IP address for spam protection: one hour.
After that, we delete the information or make it anonymous.
Your rights
Depending on where you live, you may have the right to:
- ask for a copy of the personal information we hold about you;
- ask us to correct it or complete it;
- ask us to delete it;
- object to, or ask us to limit, how we use it;
- ask for it in a portable format;
- withdraw your consent at any time, for example by unsubscribing from the newsletter.
To use any of these rights, email [email protected]. We will reply within one month. We may need to confirm who you are first.
If you are unhappy with how we have handled your information, please tell us so we can put it right. If you live in the UK or the European Economic Area, you can also complain to your local data protection authority.
If you live in the United States
Some US states, such as California, give residents extra privacy rights, including the right to know what personal information we hold, to have it corrected or deleted, and to opt out of its “sale” or “sharing”. We don’t sell your personal information or share it for targeted advertising. To use your rights, email us as above. We won’t treat you differently for doing so.
How we protect it
We use sensible technical and organisational measures to protect your information, including encrypted connections (HTTPS), access controls, strong passwords and two-step sign-in on the accounts that hold it. Only people who need your information to do their work can see it.
No website or email service is completely secure, so we can’t guarantee that information will never be accessed without permission. If something goes wrong, we will act quickly and tell you and the authorities when the law requires it.
Children
Our services are for businesses and adults. We don’t knowingly collect information from anyone under 16. If you think a child has sent us their information, contact us and we will delete it.
Other websites
Our website links to other websites and social networks, such as LinkedIn and Instagram. We aren’t responsible for how they handle your information, so please read their privacy policies.
Changes to this policy
We may update this policy from time to time. The date at the top shows when it last changed. If we make an important change, we will make it clear on this page.
